1. What this covers
Everything you send through this form (the work itself, the description,
the documents about who owns it, and the fact that you are considering
registering it) is treated by ISERDIndia Analytics as your confidential
information.
2. What we undertake
We will use what you send only to assess your work and to advise you on
protecting it. We will not disclose it to anyone outside ISERDIndia, and
we will not use it for our own purposes or for any other client.
3. Who sees it
Your brief is accessible to ISERDIndia's registered agents and the
professionals working on your enquiry, each of whom is bound by the same
duty of confidence and by the professional obligations that apply to
registered agents. ISERDIndia works with two partner firms , Doon Intellectual Property Solutions
and Patentomatic Law Consultancy, whose registered agents may also work
on your matter, and both of which send their own clients to this same
form. Each of them is bound by this undertaking. Nobody
outside these three firms sees it.
4. How long it lasts
This undertaking continues whether or not you go on to engage us, and it
does not end when your enquiry does.
5. What it does not cover
It does not apply to information that is already public, that we already
held before you sent it, that reaches us lawfully from someone else, or
that we are required to disclose by law or by a court or authority.
6. No agent-client relationship yet
Sending this form does not by itself engage us, and nothing in our reply
is legal advice until we are formally engaged and an engagement letter is
in place. We are happy to sign your own NDA instead if you prefer.

7. Your data
Your details are stored securely on ISERDIndia's systems and are never
sold or shared for marketing. Under the DPDP Act, 2023 you may withdraw
this consent or ask us to correct or erase your data at any time by
writing to info@iserdindia.org .
8. One thing we ask of you
Answer the ownership questions as they actually are, not as you would
like them to be. We are not asking you to hold anything back: publish,
sell and use the work as you please, because copyright is not lost by
publication the way a patent or a design is. But an application filed on
a chain of title that does not hold up is worse than no application,
and the Registry is not the place to find that out.

What kind of work is it?
This decides the form, the fee and the documents. If the work is really
two things, a song with lyrics for example, pick the main one and tell us
in the notes: those are usually two applications.
Literary work Books, articles, scripts, manuals, website copy, databases, poems.
Dramatic work A play, a screenplay, choreography: the written piece, not a recording of the performance.
Musical work The composition itself, the notation. The recording of it is a sound recording, which is separate.
Artistic work Logos, labels, paintings, drawings, photographs, sculpture, architecture.
Cinematograph film Films, advertisements, any moving images with or without sound.
Sound recording A recording of music, speech or any sound, whatever it is stored on.
Computer programme / software The Act treats this as a literary work, but the Registry asks for something it asks nobody else for: extracts of your source code.
The work
What is it? *
Two or three lines. Enough for us to see what is being registered.
Who made it?
The author is the person who actually created the work, not the company
that paid for it. Name the human being. For a film it is the producer,
for a sound recording the producer, for a photograph the photographer.
Joint authors optional
Anyone else who created part of it. Name them all: a joint author left off the application can undo it later.

Up to 4 MB each. If the work is a film or a long recording, send what you
can here and reply to our email with a link for the rest.
