What Is Automatically Protected

Under the Copyright Act, 1957, protection arises the moment an original work is created and expressed in some tangible form: the instant you hit publish on a post, export a video file, or save a design. No registration, no fee, no form.

Type of workCreator examples
Literary worksBlog posts, articles, scripts, captions, books
Artistic worksLogos, illustrations, graphics, photographs
Musical works and sound recordingsSongs, background scores, podcasts, voiceovers

Owning copyright means the exclusive right to reproduce the work, distribute copies, perform or display it publicly, adapt or translate it, and license or sell any of those rights.

What Copyright Does Not Cover

Protected, But Maybe Not Yours

Two situations trip up creators constantly, and both are about ownership rather than protection:

The fix for both is the same: a short written agreement saying who owns what, signed before the work starts.

Four Cheap Ways to Strengthen Your Position

1. Put a notice on your work

© Your Name, 2026. All rights reserved. It creates no new rights, but it removes the "I didn't know" defence and deters casual copying.

2. Keep dated records

Version history in Google Docs, raw footage with file metadata, layered design files with creation dates. In an ownership dispute, the person who can show the earliest drafts usually wins.

3. Register the work that matters

Registration is optional, but a registration certificate is prima facie evidence of ownership in court, which shortens fights. Apply online at copyright.gov.in. Official fees start at ₹500 per work for literary and artistic works and are higher for software, films and sound recordings; the process takes several months to a year. Register your highest-value work, not everything.

4. Decide what others may reuse

If you actually want people to share your work with credit, say so explicitly with a Creative Commons licence such as CC-BY. Clear permission upfront beats policing later.
